ATLANTA, Jun 28 (Reuters) -The U. S. drugmaker Eli Lilly & Co Inc has agreed to pay $3 billion to resolve allegations that it concealed the effectiveness of its ADHD treatment Strattera, which treats Attention Deficit Hyperactivity Disorder (ADHD).
Lilly, based in Indianapolis, is among the companies that have agreed to plead guilty in a federal court on Friday to settle a number of similar civil and criminal charges, including fraud and violation of the Securities and Exchange Commission Act, as well as civil liability. The agreement is the first time that a similar agreement has been reached since the Food, Drug, and Cosmetic Act (FDA).
The Indianapolis-based company said in a statement that it would not accept the $3 billion settlement and that the company will continue to "remain committed to resolving these accusations and seeking an appropriate remedy".
A judge in Delaware will decide the case in August on a case that is more likely to result in a second round of civil and criminal liability.
It has been more than two years since a judge dismissed a $1.6 billion lawsuit against a company that had taken a $100 million settlement in a class-action lawsuit in the U. District Court for the District of Delaware. Judge Richard W. Merritt, who took over in 2005, also sided with the company.
The suit alleged that Lilly failed to warn of the drug's risks and that, while Lilly did warn, the company failed to adequately inform patients about its treatment.
A U. Food and Drug Administration (FDA) advisers said they believed that "there was an element of confusion" about how the information that was given to doctors would actually be used in prescribing the drug.
The company said it was continuing to provide information to doctors, but said that it would not accept a $3 billion settlement and that it would not be accepting a "substantial" amount of that information. The company also said it was willing to share information from doctors and patients.
In a statement, Eli Lilly said it was "re-[.] in compliance with the U. Food and Drug Administration's (FDA) obligations to ensure that all information related to the use of Strattera is appropriately disclosed to physicians."
The company has also been cooperating with the U. Department of Justice for a number of years. In a statement, the company said that "we continue to maintain our commitment to addressing serious drug safety concerns through our regulatory and legislative efforts."
Lilly said it would continue to work with the federal government on a resolution to resolve the criminal charges and that the settlement was contingent upon the company's continued compliance with the law.
The settlement will give Lilly a larger share of the profits it brought into the company, including $1.4 billion of which it would make a single generic version, according to the company.
The settlement is part of an agreement that the company, Eli Lilly, had with a federal court in Connecticut in the United States District Court for the Northern District of Ohio.
Lilly said in a statement that it would "remain in compliance with the U. Food and Drug Administration's obligations to ensure all information related to Strattera is appropriately disclosed to physicians."
In addition to the settlement, Eli Lilly will continue to share with the FDA its own information regarding the drug's use.
In addition to the $3 billion in proceeds, the company said it would pay $1.4 billion to resolve civil and criminal charges and that the company will receive a total of $1.5 billion in payments and royalties for the settlement.
Eli Lilly will continue to work with the federal government on a resolution to resolve the criminal charges and that the company will receive a total of $1.5 billion in payments and royalties for the settlement. The company also will pay $1 billion to settle civil litigation against the federal government.
The settlement will give Lilly a larger share of the profits it brought into the company, including $1.4 billion of which it will make a single generic version, according to the company.
The company's legal team has filed more than a dozen civil and criminal lawsuits, including one that accused Lilly of illegally marketing a dangerous drug, U. Attorney David H. Cohen of the Eastern District of Pennsylvania.
AP/MARTIN KENNEDY/APShareholders' attorney Brian A. Rochon said a potential criminal prosecution could take time until the case is brought to a federal court.
